Welcome to NexHR. These Terms of Service outline the rules, obligations, and legal guidelines governing your organization's use of our Next-Gen HRMS & Onboarding SaaS platform. Please read them thoroughly before establishing your workspace database.
1. Acceptance of Agreement
By creating a NexHR employer account, registering your organization, or utilizing our HRMS platform services, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a corporate entity, you represent that you have the legal authority to bind that entity.
- These terms apply universally to all authorized administrators, HR managers, and employees accessing the workspace.
- We reserve the right to update these terms to align with legal frameworks, labor laws, and system module updates.
2. Account Registration & Tenant Security
Employers are solely responsible for maintaining the confidentiality of their administrator login keys and restricting access to authorized personnel:
- You must supply accurate, verifiable corporate registration credentials upon tenant creation.
- You must immediately notify us of any security compromise or unauthorized access to your employee workspace portal.
- NexHR is not liable for data disclosures or payroll mistakes resulting from compromised administrator passwords or credentials.
3. Corporate Workspace Databases & Ownership
Employers retain full intellectual property ownership over all uploaded employee directories, payroll datasets, leave records, and clock logs. NexHR is granted the limited right to process this data solely to run the platform:
- We process employee records strictly in compliance with our Privacy Policy guidelines.
- Employers are responsible for acquiring necessary consents from their staff members before storing personal, attendance, or payroll data.
4. Subscription Billing, Fees, & Payments
Access to NexHR is provided on a recurring subscription model. By subscribing to our platform, you agree to the payment structures:
- Invoices are generated at the beginning of each billing cycle (monthly or annually) based on active workforce counts.
- All fees are non-refundable, except where explicitly mandated by local statutory consumer protection laws.
- Direct salary disbursement files, payroll transactions, and bank payouts remain the sole operational liability of the Employer.
5. Platform Limitations & Liability
NexHR is provided as-is, designed for high-availability corporate operations. We limit our operational liability to the fullest extent permitted by law:
- We do not guarantee uninterrupted platform access during scheduled maintenance windows.
- NexHR is not liable for indirect, incidental, or consequential damages resulting from payroll ledger discrepancies, incorrect state tax calculations, or employee shift dispute logs.
